The digital age and the Internet have introduced new challenges to the ongoing battle to protect the rights of the originators and owners of intellectual property. To a segment of our society, for example, anything accessible on the Web is free -- a notion that severely threatens intellectual property rights.
Our intellectual property practice area helps clients counter that dangerous notion and protect their rights. We've done so for the makers of computer software, clothing, automobiles, handbags, jewelry and accessories, and the satellite broadcaster of network television signals. Often we investigate and prosecute civil injunctive and damage actions against individuals and companies infringing upon, counterfeiting, or diluting the trademarks and copyrights of the legitimate owners of those trademarks and copyrights.
In anti-counterfeiting cases, we regularly obtain and execute ex parte federal court seizure orders, usually followed by expedited discovery and fast track preliminary injunction hearings. These cases usually involve intensive document discovery and experts from a variety of disciplines, including accounting, economics, marketing, software auditing and questioned document examination. In addition, we have been retained by patent counsel to serve as trial and/or local counsel in patent litigation.
Kenny Nachwalter, P.A., founded in 1978 as a three lawyer firm, now consists of twenty-three attorneys.
